What is Workers’ Compensation Insurance?

by | Oct 5, 2015 | Attorneys

Many people do not realize what workers compensation is and what it covers entirely. Iowa City workers’ compensation lawyers can help with this. Workers’ compensation is an insurance that provides cash settlements, as well as, medical care if needed, for employees that have been injured or have become sick as a direct consequence of their employment. If you believe this has happened to you Iowa City workers’ compensation lawyers can help.

Employers Pay for This Insurance

Your employer, under law, has to pay for this type of insurance and it does not require you, the employee, to contribute to any portion of the cost of this compensation. Your employer’s insurance carrier, as stated by the Workers ’ Compensation Board pays weekly cash benefits, as well as, medical care if needed. The state agency that processes these claims is known as The Workers’ Compensation Board. If in any case it is deemed that investigation is necessary, it is The Workers’ Compensation Board that will determine if the insurer will be reimbursed with cash benefits and/or medical care if needed, as well as, any amounts that might be payable.

No Party is at Fault

Iowa City workers’ compensation lawyers state that in a workers’ compensation case, no one party is actually deemed to be at fault. The benefit that the claimant receives is not decreased by his or her carelessness, nor does it increase by the employer’s fault. Keep in mind that a worker may lose his or her right to compensation if the injury was a direct result of his or her intoxication from the use of alcohol or drugs, as well as, from any intention on injuring him or herself or the intention to injure someone else.

Any claim that is paid has to be approved by the employer and its insurance carrier that the injury or illness was in fact due to a work-related issue. If either the employer or their insurance carrier disputes the fact that the injury was work related there would be no cash benefits paid until a workers’ compensation judge goes over the case and decides who is in the right. Iowa City workers’ compensation lawyers can help in this type of situation. If you, as the worker, are not receiving benefits because your employer or their insurance carrier states that your injury is not job related, you as the worker, may be eligible for disability benefits in the meantime. Keep in mind that any payments that are made to you under a disability program will be subtracted from any workers’ compensation payment made to you in the future.
